Lance Corporal is charged with one charge and two specifications of Violating a Lawful General Order in violation of Article 92, UCMJ; one charge and two specifications of Maltreatment, in violation of Article 93, UCMJ; one charge and five specifications of Assault Consummated by a Battery, in violation of Article 128, UCMJ; and one charge and one specification of Obstructing Justice, in violation of Article 134, UCMJ. In sum, LCpl is facing up to 10 years in prison, reduction to E-1, total forfeitures, and a federal conviction. LCpl retains Mr. Robert Capovilla. Mr. Capovilla immediately contacts the military prosecutor and explains that several of the charges were multiplicious and greatly exaggerate his client’s criminality. After discussing the case thoroughly with the LCpl, his family, and the military prosecutor, the Marine Corps drops all charges and specifications and agree not to prosecute the client.

NO Federal Conviction, NO Confinement and NO Discharge.
