O-4 is accused of committing sexual harassment and possibly abusive sexual contact against a member of his team. Robert Capovilla serves as the 0-4’s attorney and represented throughout the process. Mr. Capovilla discovers that there were 3 other people in the room when the alleged misconduct occurred and not one them saw the 0-4 commit any misconduct. In fact, two of those witnesses state that the 0-4 did not commit any misconduct. Mr. Capovilla drafts a memo for the 0-4’s commander and the command decides to drop all charges.
