Domestic Violence and Assault

We will stand by you!

The attorneys at Capovilla & Williams have been litigating domestic violence cases in the military for the past decade. Here is what we know – there are more false allegations of domestic violence than any other type of allegation in the DoD. Here is what else we know – domestic violence allegations are extremely serious and can lead to years in federal prison, protective orders, loss of your right to bear arms, custody battles over your children, and a punitive discharge, which may erase years of dedicated service.

Your commander will not stand with you.

Let us speak truthfully with each other, if there is an allegation of domestic violence your commander will not have your back and risk their own career to save you. You know this, and we know this. Your commander, even if he/she thinks the evidence is weak, will want to punt the ball to someone else and that someone else is usually a military panel. If you think we are wrong, go look at the facts. In today’s political culture, we are seeing astronomically high amount of domestic violence cases going to trial. Is that because more service members are committing domestic violence, or is this because more and more commanders realize that they will lose their command or their stars if they take a stand for you?

At Capovilla & Williams we have seen accusers forge medical documents, fake injuries, self-mutilate to frame our clients, lie, exaggerate, blackmail, bribe, and convince their children to make up stories of abuse and neglect. Yet, these cases are going to trial for the panel to decide. Those are the facts; this is the reality. The question is what are you going to do if you are the victim of a false allegation?
