After conducting a thorough investigation, our client successfully secured the dismissal of all sexual assault allegations. Despite the Government seeking 3 years in confinement and a dishonorable discharge, our advocacy preserved the client’s career by avoiding any discharge and limiting confinement to just 11 months.
Case Result #2: Our client, an E-6 paralegal, faced serious accusations of sexual assault. After enduring months of investigation by OSI, charges were brought against him. He made a decisive choice to hire Attorney Robert Capovilla as his lead counsel. Without wasting time, Robert launched a thorough investigation into the case, uncovering evidence that seriously undermined the alleged victim’s account of the events.
Robert took assertive action by filing over a half dozen motions, including a compelling motion to obtain the alleged victim’s phone records. Following the motions hearing, the alleged victim opted not to comply with the judge’s order to provide her phone records for the trial. This pivotal decision led to the complete dismissal of all sexual assault allegations against our client.
This outcome was not just a victory; it provided our client with a fresh start, allowing him to move forward with his life free from the burden of sex offender registration.
Case Result #3: Our client, a senior NCO in the Air Force, faced false allegations of sexual assault from his ex-girlfriend. The OSI conducted a flawed investigation into their two-year relationship and hastily concluded that there was probable cause to support the claims against him. Recognizing the threat to his reputation and the 15 years of dedicated service he had provided, he enlisted Capovilla & Williams to vigorously defend his rights.
We wasted no time and immediately assigned our top investigator, Mr. Denny Richter, to the case. Mr. Richter uncovered critical text messages from the time of their relationship that effectively undermined the alleged victim’s account. As a direct result of this compelling evidence, military prosecutors made the wise decision to dismiss all criminal allegations against our client. He successfully avoided a court-martial.
However, the challenge didn’t end there. Shortly after the dismissal, the command attempted to instigate a separation board. We were ready for them; we presented irrefutable evidence from our investigation that demonstrated the alleged victim had a clear motive to fabricate her claims, had previously lied, and was acting out of a desire for revenge. Ultimately, all allegations against our client were dropped. He faced no court-martial, no separation board, and his retirement remains secure.
