Below is a brief overview of some case results from Fort Stewart, showcasing our extensive experiences:
Case Result #1: We proudly represented a Sergeant First Class with over 19 years of exemplary service who was falsely accused of abusive sexual contact by a Soldier under his leadership. The military prosecutors aggressively pursued these baseless allegations, even managing to enlist 2-3 other Soldiers to accuse our client. They charged him with these serious claims, leading to a General Court-Martial. However, as we prepared for the trial, we uncovered critical evidence that the prosecuting attorneys at Fort Stewart had overlooked. We found orders confirming that at the precise time our client was accused of these crimes, he was actually engaged in training at Fort Lee. Once this evidence came to light, the foundation of the prosecution’s case crumbled. The outcome? Our client was found not guilty of all charges and is now enjoying a well-deserved retirement.
Case Result #2: Our client, a junior officer, was unjustly charged with several allegations of sexual assault under Article 120 of the Uniform Code of Military Justice. The alleged victim claimed she lacked the competency to consent to sex after having drinks with him and going back to his house. Despite the flimsy nature of the accusations, military prosecutors were unwilling to engage in any reasonable negotiations and displayed an overwhelming confidence in securing a conviction. Their intent was clear: to label our client a lifelong sex offender and sentence him to spending his formative years in prison.
During trial, we conducted a rigorous 6-hour cross-examination that revealed significant discrepancies in the alleged victim’s account. She remembered far more than she had initially disclosed to the CID and repeatedly altered her story throughout the proceedings. After 5 intense days of litigation, our client was found not guilty on all charges. Today, he has not only reclaimed his reputation but has also been promoted, with his career firmly back on track.
Case Result #3: Our client, a decorated E-7 with over 17 years of honorable military service, faced serious allegations from his ex-wife, including sexual assault, domestic violence, and communicating threats. This case was escalated to an Other Than Honorable Separation Board, where Daniel Higgins from Capovilla & Williams took the reins, going head-to-head with a formidable team of attorneys representing the ex-wife.
Dan skillfully demonstrated that the allegations were made only after our client discovered her affair and initiated divorce proceedings. The board hearings spanned several days, during which Dan effectively revealed that CID had conducted a weak, biased, and incomplete investigation. Despite the recorder’s impassioned plea for an Other Than Honorable Discharge, the board members ultimately saw through the unfounded claims. They not only retained our client but also dismissed the allegations entirely. As a result, our client is now poised to retire with all his benefits intact.
