Case Result #1: A decorated Army Green Beret enlisted the expertise of Capovilla & Williams after facing weak allegations of sexual harassment from a civilian employee on base. His command, in a misguided response, initiated a 15-6 investigation that erroneously concluded our client’s actions constituted sexual harassment. We took up the challenge at his separation board, demonstrating that the allegations lacked merit, that the alleged victim had grossly exaggerated the events, and that given our client’s exemplary service, separation was unwarranted. The outcome? The Green Beret was not only retained in the Army but is now on a clear path to retirement.

Case Result #2: Our LTC client faced accusations of domestic violence after his spouse filed a complaint with local authorities. She alleged that he was preventing her from leaving, causing her vehicle to fail to start, sending her threatening text messages, and stalking her at a friend’s house. Consequently, the Command issued a FLAG against him, which restricted his ability to get promoted and participate in any unit functions.

After conducting our own investigation into the allegations, we discovered that the accuser had a history of making outlandish claims against our client. In response, we filed an Article 138 complaint, asserting that the Command had exceeded its legal authority by unlawfully restricting our client to post. Furthermore, we presented a strong argument for dropping all allegations against him. Ultimately, our efforts paid off: the LTC was promoted, all restrictions were lifted, and the allegations under investigation were dismissed.

Case Result #3: Our junior enlisted client was facing court-martial charges for allegedly viewing and possessing explicit material. The Government made serious allegations, claiming he committed several sex offenses and charging him with multiple felony-level offenses. However, Attorney Brad Simon, as lead counsel, alongside his investigator, Mr. Justin Powers, quickly uncovered critical information: our client was using an “open” internet router that was accessible to several other individuals. This crucial evidence demonstrated that the military prosecutors had exaggerated the alleged wrongdoing and could not prove their case beyond a reasonable doubt. As a result, all charges against our client were dismissed. He faced no convictions, and there was no requirement for sex-offender registration.
